THE IMPORTANCE OF THE CHAIN OF CUSTODY IN CRIMINAL PROCEEDINGS: THE NEGLIGENCE OF THE TECHNICAL DEFENSE IN ITS OBSERVANCE

Abstract

This article discusses the relevance of the chain of custody in Brazilian criminal proceedings, highlighting its role in ensuring the authenticity, integrity and traceability of evidence. It emphasizes the negligence of some lawyers in its supervision, which can compromise the full exercise of adversarial proceedings and full defense. The research is based on a qualitative analysis of current legislation, court decisions and case studies, demonstrating the damages caused by the lack of adequate technical objection to defects in the chain of custody. It is concluded that diligent action by the defense on this point is essential to protect the fundamental rights of the accused and to legitimize the criminal proceedings.
